Agreement to Terms

By downloading, installing, or using the Classical Guitar Flash Cards app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

Classical Guitar Flash Cards is an educational application that allows you to:

• Practice note positions on the classical guitar fretboard
• Learn through six different practice modes
• Track your progress and statistics
• Hear notes played via MIDI audio
• Customize app settings (fret range, left-handed mode, audio)
• Store practice data locally on your device

Use License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

You May:

• Use the App on devices you own or control
• Practice with unlimited sessions
• Use the App offline
• Reset your progress at any time

You May Not:

• Copy, modify, or reverse engineer the App
• Distribute or resell the App
• Remove any copyright or proprietary notices
• Use the App for any illegal purpose
• Attempt to gain unauthorized access to any part of the App

User Content

Your Data

All practice data, progress statistics, and settings you create in the App remain on your device. We do not have access to this data.

Your Responsibility

You are solely responsible for:

• The security of your device
• Maintaining your practice data (resetting progress will delete all data)
• Understanding that uninstalling the app will delete all local data

Data Backup and Loss

Important: While we strive to provide a reliable service:

• All data is stored locally on your device only
• We are not liable for any data loss that may occur
• Deleting the app will delete all your progress data
• Device resets or failures may result in data loss
• We do not provide cloud backup or data recovery services

Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• That the App will be uninterrupted or error-free
• That defects will be corrected
• That the App is free of viruses or harmful components
• That MIDI audio will work on all devices

Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of data, use, revenue, or profits
• Our total liability shall not exceed the amount you paid for the App (if any)

Educational Purpose

This App is designed as an educational tool for learning classical guitar. While we strive for accuracy:

• The App is not a substitute for professional music instruction
• We make no guarantees about learning outcomes
• Musical notation and positions are provided for educational purposes only

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your information.

Updates and Changes

App Updates

We may release updates to the App that:

• Add new features or practice modes
• Fix bugs or security issues
• Improve performance and user experience
• May require you to update to continue using the App

Terms Updates

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after changes constitutes acceptance of the new Terms.

Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

App Store Terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and us, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for any claims related to the App
• Your use is also subject to Apple's App Store Terms of Service
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms

Intellectual Property

The App, including its design, code, graphics, and content (excluding your practice data), is owned by us and protected by copyright, trademark, and other intellectual property laws.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

• Good faith negotiation first
• If negotiation fails, through binding arbitration or small claims court
• You waive any right to participate in class action lawsuits

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
